SIOUX FALLS, S.D. (KWAT)–The suspect charged in the fatal shooting of Minnehaha County Sheriff’s Deputy Katherine Frank (pictured) has now been indicted on first-degree murder charges.

Thirty nine year-old Brandon Oetken is indicted on first-degree and second-degree murder, according to court documents.

Oetken also faces seven additional aggravated assault charges and two counts of attempted first-degree murder.

Frank and the other deputies were at Oetken’s residence in western Sioux Falls to serve a mental illness hold on him, according to court documents.

Upon the deputies’ arrival on October 9, after speaking with officers, authorities say Oetken retreated into his home, where he then produced a handgun pointing and firing it at the deputies, striking Deputy Frank.
